END USER LICENSE AGREEMENT

This End User License Agreement ("EULA") is a legal agreement between you and Berean 1711™™ (copyright registered; trademark pending), a property operated by Bullet Proof Marketing Systems, Inc. (operating under the tradename Ryzenda) ("we," "us," "our"), governing your access to and use of the Berean 1711™ software service, the Berean 1711™ system prompt, lens definitions, scoring criteria, report templates, user interface, and any documentation (collectively, the "Licensed Materials"). This EULA is incorporated into, and forms a part of, the Terms of Service.

1. License grant

Subject to your continued compliance with this EULA, the Terms of Service, and the Acceptable Use Policy, and subject to payment of any applicable subscription fees, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Licensed Materials for your own internal, non-commercial study and pastoral reflection during your subscription term.

2. Ownership

The Licensed Materials are licensed, not sold. All right, title, and interest in and to the Licensed Materials — including all intellectual property rights in the Berean 1711™ name, logo, system prompt, lens taxonomy, scoring rubric, report structure, source code, and design — are and remain the exclusive property of Bullet Proof Marketing Systems, Inc. and its licensors. The name and mark BEREAN 1711™ are the subject of registered copyright and pending trademark protection. No rights are granted by implication, estoppel, or otherwise.

3. Restrictions

You will not, and will not permit any third party to:

  • copy, modify, translate, or create derivative works of the Licensed Materials;
  • reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code, prompt text, lens definitions, or scoring logic;
  • rent, lease, lend, sell, sublicense, distribute, or otherwise transfer the Licensed Materials or access to them;
  • use the Licensed Materials to build a competing product, service, dataset, or model, or to train, fine-tune, or benchmark any AI system;
  • remove, alter, or obscure any copyright, trademark, or other proprietary notices;
  • use scrapers, bots, or other automated means to access the Site except through documented interfaces we expressly authorize; or
  • use the Licensed Materials in any manner that violates the Acceptable Use Policy or applicable law.

4. Your content and reports

You retain ownership of the text you submit ("User Content"). You grant us a worldwide, royalty-free license to process User Content solely to operate the Site, generate reports, and provide support. Reports generated by the Site combine your User Content with our Licensed Materials; you may use the resulting report for your own private study subject to the Berean Discernment Report Disclaimer and the Acceptable Use Policy, but you may not publish it, post it publicly, or redistribute it in a manner that identifies any specific teacher or ministry without our prior written consent.

5. Feedback

If you provide suggestions, ideas, or feedback about the Site, you grant us a perpetual, irrevocable, royalty-free, worldwide license to use them for any purpose without obligation to you.

6. Subscription, term, and termination

This EULA is effective when you first access the Site and continues until terminated. Your license is contingent on an active, paid subscription (where applicable) and on your ongoing compliance with this EULA, the Terms of Service, and the AUP. We may suspend or terminate your license at any time for breach; you may terminate at any time by discontinuing use and closing your account. Sections 2, 3, 5, 7, 8, and 9 survive termination. Termination does not entitle you to a refund of any fees — see the no-refund provisions in the Terms of Service.

7. Warranty disclaimer

THE LICENSED MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, OR NON-INFRINGEMENT. AI-GENERATED OUTPUT MAY BE INCOMPLETE, MISTAKEN, OR MISLEADING; YOU ARE SOLELY RESPONSIBLE FOR EVALUATING IT AGAINST SCRIPTURE AND SOUND COUNSEL.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL BULLET PROOF MARKETING SYSTEMS, INC., RYZENDA, OR OUR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR REPUTATION, ARISING OUT OF OR RELATED TO THE LICENSED MATERIALS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATED TO THE LICENSED MATERIALS WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

9. Governing law

This EULA is governed by the laws of the Province of Alberta, Canada, without regard to conflict-of-law principles. Exclusive jurisdiction and venue lie with the courts of Alberta.

10. Entire agreement

This EULA, together with the Terms of Service, Acceptable Use Policy, Privacy Policy, and Berean Discernment Report Disclaimer, constitutes the entire agreement between you and us concerning the Licensed Materials and supersedes any prior understanding.
